MCS Rules 1961-CHAPTER I



PRELIMINARY

1.

Short title and extent:-


These rules may be called the Maharashtra Co-operative Societies Rules. 1961.


(1)
They extend to the whole of the State of Maharashtra.
2.

Definitions:-


In these rules, unless the context otherwise, requires. —


(a)
"Act" means the Maharashtra Co-operative Societies Act. 1960;


(b)
"Apex Co-operative Bank" means a federal co-operative bank having jurisdiction over the whole of the Maharashtra State and recognised as such by the State Government for the purpose;


(c)
"Co-operative year" means the year ending on the 30th day of June or in the case of any society or class of societies, the accounts of which are with the previous sanction of the Registrar, balanced on any other day. the year ending on such day;


(d)
"decree" means any decree of a Civil Court, and includes any order, decision or award referred to in sub-section (1) of Section 156;

(e)
"decree holder" means any person holding a decree;


(f)
"form" means a form appended to these rules;


(g)
"Record of Rights" means: -


(i)
as respects the Bombay area of the State, the record of rights maintained under the Bombay Land Revenue Code, 1879;


(ii)
as respects the Vidarbha region of the State, the record of rights maintained under the Madhya Pradesh Land Revenue Code, 1954;


(iii)
as respects the Hyderabad area of the State the Settlement Register maintained under Section 86 of the Hyderabad Land Revenue Act, 1317-F;

(h)
"recovery officer" means any person empowered to exercise in any district, the powers of the Registrar under Section 156;


(i)
"the registered society" means a society registered or deemed to be registered under the Act;


(j)
"sale officer" means an officer empowered by the Registrar, by general or special order, to attach and sell the property of defaulters or to execute any decree by attachment and sale of property;


(k)
"section" means a section of the Act,
